Cowboy Davis is deeply committed to the Collaborative Family Law Process.  This alternative method of obtaining a divorce has been received with enthusiasm by both clients and judges.  Collaborative Family Law is based on an agreement between both parties and their attorneys to respect each other and fully disclose information about their community estate.  Open and honest communication between husband and wife is the key for reaching a successful and harmonious solution.  Rather than creating bitterness and hatred between husband and wife, this process allows the couple to negotiate a dissolution of their marriage under terms and conditions best suited to their family's needs.

While collaborating on the terms of the settlement, the two parties have the comfort and security of professional guidance from their respective attorneys. Additionally, both sides work together instead of pitting each spouse against the other as in traditional divorce procedures. Collaborative Family Law is designed to encourage all parties to work in a positive and humane manner to restructure family dynamics when divorce becomes the only solution to the marriage conflict.

In the Collaborative Family Law process, the clients and their attorneys schedule a series of group meetings which allow the parties to share information about their assets and liabilities in order to reach fair and amicable solutions. The lawyers provide the clients with an environment conducive to respect and the process is focused on reaching compromises, not placing blame. Although collaborative lawyers still advise clients on their legal rights and possible outcomes of issues in court, they never resort to or threaten to go to court as a means of settling conflict.

In fact, in the contract the lawyers sign with the parties, they are prohibited from representing their client in court if a settlement is not reached. This prohibition from appearing in court, except to request an entry of an agreed final decree or permission to withdraw, places the attorney on the same economic plane as the client. If the dispute resolution fails, the attorney loses additional fees and the parties hire new representation. This removes the incentive for either attorney to use a "win at all costs" approach.

Instead, collaborative attorneys use skillful techniques to improve their clients' abilities to communicate and focus on the big picture. Each party is encouraged to share his or her own needs, desires, and possible acceptable outcomes. This process calls for the attorneys to be facilitators and advisors who empower and enable parties to come to mutually fair agreements. In this manner, husbands and wives take responsibility for making their own settlements, not the attorneys.

Divorce is like a disability in that it can either provide an opportunity to overcome challenges by restructuring family dynamics positively or it can cripple a family by creating a negative experience for all.
